AN ONTARIO COURT RULES THE “MORE BEDS, BETTER HEALTH CARE ACT” DOES NOT VIOLATE THE CHARTER OF RIGHTS AND FREEDOMS

An Ontario court has thrown out a charter challenge of a provincial law that allows hospitals to move older patients into long term care homes they didn’t choose, or charge then $400 a day if they want to stay in hospital.
The case, brought by the Advocacy Centre for the Elderly and the Ontario Health Coalition, argues the “More Beds, Better Health Care Act” violates the charter of rights and freedoms.
But the judge who dismissed the case found that Bill 7 does not contravene the charter and has an important objective, to reduce the number of patients in hospital eligible for admission to long term care in order to maximize hospital resources.
The bill was passed by the Doug Ford government in September 2022 and has sparked outage among advocates, seniors and their caregivers.
